Terms of Service

1. Acceptance of Terms

By accessing or using any product or service operated by BeccaOS LLC ("Company", "we", "us"), including but not limited to Sonny, Colony OS, and any services available via beccaos.com and associated subdomains (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Services.

2. Description of Services

BeccaOS LLC develops and operates AI-powered business tools for various industries. Our current products include Sonny (AI-powered restaurant ordering and management), Colony OS (AI project orchestration), and additional tools as they become available. Each product is a multi-tenant SaaS platform providing web applications, APIs, AI features, and integrations with third-party services.

3. Account Registration

To use the Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Billing

The Services offer multiple subscription tiers which may vary by product. Paid subscriptions are billed monthly or annually through Stripe. You authorize us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are available within 14 days of initial purchase.

5. SMS & Text Message Terms

Certain Services include SMS/text message notifications for order updates, delivery status, and service alerts. By opting in to SMS notifications:

• You consent to receive automated text messages at the phone number you provide
• Message frequency varies based on your activity and order volume
• Message and data rates may apply depending on your carrier plan
• You can opt out at any time by replying STOP to any message
• For help, reply HELP or email support@beccaos.com
• Consent is not a condition of purchase — you may use the Services without SMS
• We will not send promotional SMS without your explicit opt-in consent

6. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Services
• Interfere with or disrupt the Services or servers
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to transmit harmful, offensive, or misleading content
• Resell or redistribute the Services without authorization
• Use SMS features to send spam, unsolicited messages, or messages unrelated to the Services

7. Data Ownership

You retain ownership of all data you upload to the Services, including business data, customer information, and configurations. We do not claim ownership of your content. You grant us a limited license to process, store, and display your data solely for the purpose of providing the Services.

8. AI & Automated Services

The Services use artificial intelligence for various functions including order processing, voice recognition, customer interactions, and analytics. While we strive for accuracy, AI-generated responses may contain errors. You are responsible for reviewing AI-assisted outputs and communications. AI features operate within configurable boundaries that you control through your dashboard settings.

9. Third-Party Integrations

The Services integrate with third-party providers including Google Firebase (authentication), Stripe (payments), Twilio (SMS), SendGrid (email), Deepgram (voice), ElevenLabs (speech), and OpenAI/Google Gemini (AI). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for third-party service availability or data practices.

10. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. Enterprise plans may include an SLA with specific uptime guarantees and remediation terms.

11. Limitation of Liability

To the maximum extent permitted by law, BeccaOS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data, arising from your use of the Services. Our total liability shall not exceed the amount you paid for the Services in the twelve months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Services ceases immediately. You may request an export of your data within 30 days of termination. After 30 days, we may delete your data in accordance with our data retention policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
